All content on this Website, including but not limited to text, graphics, logos, images, photographs, audio clips, digital downloads, data compilations, software, and the overall design and layout of the Website (collectively, the "Content"), is the exclusive property of Mod Pizza or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.

- Any conduct or content of any third party on the Website;
- Any content obtained from the Website;

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, to access or use the Website in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.
7. Disclaimers
THE WEBSITE AND ALL CONTENT, SERVICES, PRODUCTS, AND OTHER MATERIALS MADE AVAILABLE THROUGH THE WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, MOD PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Any warranty that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
- Any warranty regarding the accuracy, reliability, timeliness, or completeness of any information on the Website;
- Any warranty that defects will be corrected;
- Any warranty regarding the results that may be obtained from using the Website.
We do not warrant or make any representations regarding the use or the results of the use of the materials on this Website in terms of their correctness, accuracy, reliability, or otherwise. Nutritional information, allergen data, and ingredient lists are provided for informational purposes only and may not be complete or fully accurate due to variations in food preparation processes, supplier changes, or human error. Users with food allergies or specific dietary requirements are strongly encouraged to contact us directly before ordering.
The foregoing disclaimers shall apply to the fullest extent permitted by applicable law, including applicable provisions of the Federal Trade Commission Act (FTC Act) as enforced by the Federal Trade Commission.
8. Indemnification
You agree to defend, indemnify, and hold harmless Mod Pizza, its parent company, subsidiaries, affiliates, officers, directors, shareholders, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use of the Website, including any data or content transmitted or received by you;
- Your violation of any rights of another party, including but not limited to intellectual property rights, privacy rights, or contractual rights;
- Your violation of any applicable law, rule, or regulation, including but not limited to any federal, state, or local laws;
- Any content submitted by you through the Website;
- Any fraudulent, negligent, or intentional misconduct on your part;
- Any third-party claims arising from your use of the Website.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with us in asserting any available defenses. You agree not to settle any such matter without our prior written consent.
9. Governing Law and Jurisdiction
These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the United States of America and the applicable laws of the state in which Mod Pizza is registered and operating, without giving effect to any choice or conflict of law provision or rule.
For matters subject to federal jurisdiction, you agree to submit to the personal and exclusive jurisdiction of the federal courts located within the United States. For matters subject to state jurisdiction, you agree to submit to the personal and exclusive jurisdiction of the state courts located in the applicable state.
You acknowledge and agree that any dispute, claim, or controversy arising from your use of this Website or these Terms that cannot be resolved through the dispute resolution process described herein may be brought in a court of competent jurisdiction in the United States, and you hereby waive any objection to the laying of venue in such courts.
These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods. The application of the Uniform Computer Information Transaction Act (UCITA) is also excluded from these Terms.
10. Dispute Resolution
10.1 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first attempt to resolve any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof (collectively, "Dispute") by contacting us informally at [email protected]. We will attempt in good faith to resolve any Dispute through informal negotiation within thirty (30) days of receipt of your notice.
10.2 Binding Arbitration
If informal resolution fails, you agree that any Dispute shall be resolved through final and binding arbitration, rather than in court. Arbitration proceedings shall be conducted by a recognized arbitration organization under its then-current rules, and the arbitration shall take place in the United States.
The arbitrator shall have the authority to grant any remedy or relief that would be available in a court of law. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. You acknowledge that by agreeing to arbitration, you are waiving your right to a jury trial.
10.3 Class Action Waiver
YOU AND MOD PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Mod Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
10.4 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.
11. Term and Termination
These Terms of Service shall remain in full force and effect while you use the Website. We reserve the right, in our sole discretion, to:
- Suspend or terminate your access to all or part of the Website at any time, with or without notice, for any reason, including but not limited to your breach of these Terms;
- Discontinue or modify the Website or any service or material we provide on the Website, in our sole discretion without notice;
- Terminate any account you have created on the Website at any time and for any reason.
Upon termination of your access to the Website:
- Your right to use the Website will immediately cease;
- Any provisions of these Terms which by their nature should survive termination shall survive, including without limitation intellectual property rights, disclaimers, indemnification, limitations of liability, and dispute resolution;
- We may, but are not obligated to, delete any content or information associated with your account.
If you wish to terminate your account or your use of the Website, you may simply discontinue using the Website. You may also contact us at [email protected] to request account deletion.
12. Changes to Terms
Mod Pizza reserves the right, at our sole discretion, to modify, update, or replace any part of these Terms of Service at any time. We will provide notice of any material changes by:

It is your responsibility to check this page periodically for changes. Your continued use of or access to the Website following the posting of any changes to these Terms constitutes your acceptance of those changes. If you do not agree to the modified Terms, you must stop using the Website immediately.
In the event of any conflict between the current version of these Terms and any previous version(s), the current version shall prevail. We will always make the current version of these Terms available on our Website.
13. Third-Party Links and Services
The Website may contain links to third-party websites, applications, services, or resources that are not owned or controlled by Mod Pizza. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit. Your access to and use of third-party websites is governed by the terms and conditions and privacy policies of those websites, not these Terms.
References or links to any third-party products, services, or websites do not constitute or imply our endorsement, sponsorship, or recommendation of such third parties or their products, services, or websites.
14. Privacy and Data Protection
Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, disclose, and protect your personal information. By using the Website, you consent to the collection and use of information as described in our Privacy Policy.
We comply with applicable United States federal and state privacy laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) for California residents, the Federal Trade Commission Act (FTC Act) regarding unfair or deceptive acts or practices, and other applicable federal and state data protection regulations.
California residents have specific rights under the CCPA/CPRA, including the right to know about personal information collected, the right to delete personal information, the right to opt-out of the sale or sharing of personal information, and the right to non-discrimination. For more information, please review our Privacy Policy or contact us at [email protected].
15. Food Safety and Allergen Notice
Mod Pizza takes food safety seriously. However, we cannot guarantee that any food item is completely free from allergens. Our food products are prepared in facilities that may handle common allergens including but not limited to wheat, gluten, dairy, eggs, nuts, soy, and shellfish.
If you have any food allergies, intolerances, or specific dietary requirements, we strongly encourage you to:
- Review allergen information carefully before ordering;
- Contact us directly at [email protected] before placing your order;
- Speak with our staff at the location before consuming any food product.
Mod Pizza shall not be liable for any adverse reactions, injuries, or health consequences resulting from food allergies or dietary sensitivities when reasonable allergen information has been made available and the user has failed to review or inquire about such information prior to ordering.
16. Severability
If any provision of these Terms of Service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of these Terms will continue in full force and effect.
The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, and the parties agree that a court may modify such provision so as to render it enforceable while preserving to the greatest possible extent the original intent of the parties as expressed herein.
These Terms of Service, together with our Privacy Policy and any other legal notices published by us on the Website, shall constitute the entire agreement between you and Mod Pizza concerning the Website and supersede all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Website and its subject matter.
17. Waiver
No waiver by Mod Pizza of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Mod Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
The failure of either party to enforce any provision of these Terms shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of these Terms.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy, Cookie Policy (if applicable), and any other agreements or policies referenced herein, constitute the entire agreement between you and Mod Pizza with respect to your use of the Website and supersede all prior and contemporaneous agreements, proposals, negotiations, representations, or warranties of any kind regarding the Website, whether written or oral.
In the event of any conflict between these Terms and any other agreement between you and Mod Pizza, these Terms shall control unless the other agreement specifically states otherwise.
19. Electronic Communications
